Restaurant chain sued by injured motorcyclist.

An Ohio man is suing the Quaker Steak and Lube restaurant chain for injuries he sustained in a motorcycle accident this past August.

According to the lawsuit, David Privett is suing the Pennsylvania-based company for injuries he received as a result of a motorcycle accident caused by an intoxicated customer. Quaker Steak and Lube, which boasts 35 locations nationwide, is known for its motor-themed setting and often attracts motorcyclists and car enthusiasts.

On the night the accident occurred, David Privett was riding his motorcycle to the restaurant chain's Milford, Ohio location when he collided with Jason Carpenter, another motorcyclist. According to police reports, Mr. Carpenter had been drinking at the restaurant earlier that evening and was just a half a mile away when he lost control of his bike, crossed the center line and hit a guardrail. Mr. Carpenter was thrown from the bike and killed instantly while the motorcycle skidded into Mr. Privett's lane, striking him head-on. He sustained serious injuries as a result of the accident, including a fractured pelvis, fractured leg and the loss of his remaining leg due to severe nerve damage.

The lawsuit, filed on October 25th, alleges that Quaker Steak and Lube should be held responsible for Mr. Privett's injuries because they served Mr. Carpenter an excessive amount of alcohol and then allowed him to drive. At the time of the accident, Mr. Carpenter's blood alcohol level was twice the legal limit. Representatives from the restaurant chain have declined to comment on the lawsuit at this time.

While the outcome of the lawsuit is still uncertain, the victim in this case acted responsibly in contacting a personal injury attorney to discuss his case. While the other motorcyclist cannot be held responsible for his negligent actions in causing the motorcycle accident, the restaurant may be required to compensate the victim for his medical bills, lost wages, permanent injuries and pain and suffering.
